YOUR ASSETS
Do you own a personal business or a farm? If yes, please specify. Do you want this business to be given to a specific beneficiary or pass to all beneficiaries with the rest of your estate?
Do you own real estate? (If you own property jointly with another person such as your spouse, it will automatically pass to the surviving owner. But that person could predecease you so you may want to consider naming an alternate beneficiary.) If you do own property, include the street address or (preferable) the legal description from the deed for all real estate.
Do you want to give away specific grants of cash to specific people (normally not your primary beneficiaries) before dividing the rest of your assets? (This does not include your life insurance policy, which is separate from your estate and not included in a will.) If so, provide the name(s), amount of money, and their relationship to you.
You can bequeath specific items of your personal property (your car, jewelry, furniture, other possessions) to specific individuals in your will. However, we recommend you instead create a Personal Property Memorandum separate from the will. This document is a list of your items and whom you want to give them to, but it is separate from your will. As such, you can change it anytime you want without altering your will or having to contact your attorney. You can store this Personal Property Memorandum with your will.
THE REST OF YOUR ASSETS
The law calls everything you do not specifically bequeath your "residuary estate." This can include both intangible property such as bank accounts, stocks, bonds and the like as well as any tangible items. If you are leaving anything to a minor child, also name the "trustee" who is to manage it until the child comes of age, and indicate what age (typically 18 or 21) you wish the child to be free of the trust.
